Acceptance of Terms
By accessing or using Advocate CMS(the “Service”), you agree to these Terms of Service (“Terms”). If you are using the Service on behalf of an organization (the “Customer”), you represent that you are authorized to accept these Terms on its behalf.
The Service
Advocate CMS is a subscription-based software-as-a-service platform intended to help organizations manage legal case workflows (including documents, notes, calendars, and team collaboration). We may change, update, or improve the Service from time to time.
Hikmotic Sol Pvt Ltd is not a law firm and does not provide legal advice. The Service is a productivity tool and does not replace your professional judgment.
Accounts and Organization Administration
- Users must be at least 18 years old (or the age of majority where they live) to create an account.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- You agree to provide accurate information and keep your account details up to date.
- Customer administrators may manage user access, roles, and permissions within the Service. If your access is through a Customer, your use may be subject to your organization’s policies.
Subscriptions, Billing, and Payment Processing
- The Service is offered on a subscription basis. Your subscription may include usage limits and features based on your selected plan.
- Subscriptions renew automatically at the end of each billing cycle unless canceled in accordance with these Terms.
- Payments are processed by Razorpay (Razorpay Software Private Limited). Your use of Razorpay is governed by its own terms and policies. We do not store full payment card details.
- You are responsible for any applicable taxes, duties, or withholdings associated with your subscription.
- We may change pricing or plans from time to time. If changes apply to you, we will provide notice and they will take effect on your next renewal (unless otherwise required by law).
- If payment fails or becomes past due, we may suspend or limit access to the Service until payment is received.
Cancellation
You may cancel your subscription at any time. Unless we state otherwise, a cancellation will take effect at the end of your current paid billing period. We do not provide prorated credits for partial periods.
Refund Policy (No Refunds)
All fees are non-refundable and non-creditable, except as required by law.
We do not provide refunds or credits for any unused subscription time, downgrades, partial billing periods, or account inactivity.
Free Trials
Advocate CMS offers a 7-day free trial on eligible plans. During the trial:
- No credit card is required to start. You will not be charged automatically at the end of the trial period.
- You get full access to all features of your selected plan for the duration of the trial.
- At the end of the 7-day trial, your workspace will be placed in a read-only state. You will need to subscribe to a paid plan to continue creating or editing data.
- We reserve the right to modify, shorten, or discontinue free trials at any time without notice to prospective users. Active trials will not be shortened without prior notice.
Trial workspaces that remain inactive (no logins) for more than 30 days after trial expiry may be permanently deleted. We will attempt to notify the registered email address before deletion.
Acceptable Use
You agree not to misuse the Service or help anyone else do so. In particular, you will not:
- Access or attempt to access accounts or data without authorization.
- Interfere with or disrupt the Service or its security features.
- Upload malware, exploit vulnerabilities, or perform penetration testing without written permission.
- Reverse engineer, decompile, or attempt to extract source code except as allowed by law.
- Use the Service in violation of applicable laws or professional obligations.
Customer Content
Customer and its users retain ownership of content submitted to the Service (including case data, notes, and files) (“Customer Content”). Customer grants Hikmotic Sol Pvt Ltd a limited license to host, process, transmit, and display Customer Content only as necessary to provide, secure, and support the Service.
Customer is responsible for ensuring it has all rights and permissions necessary to submit Customer Content and for the legality of such content.
Confidentiality and Security
We use administrative, technical, and physical safeguards designed to protect information processed by the Service. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Third-Party Services
The Service may integrate with third-party services. Your use of those services is governed by their terms and policies, not these Terms. We are not responsible for third-party services.
Disclaimers
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, Hikmotic Sol Pvt Ltd will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, goodwill, or business interruption, arising out of or related to your use of the Service.
To the maximum extent permitted by law, our aggregate liability for all claims relating to the Service will not exceed the total fees paid by the Customer for the Service in the 12 months immediately preceding the event giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless Hikmotic Sol Pvt Ltdand its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, or your Customer Content.
Termination
We may suspend or terminate access to the Service if we reasonably believe you have violated these Terms, if payment is overdue, or if needed to protect the Service and its users. Customer administrators may also suspend or terminate a user’s access. Upon termination, your right to use the Service will stop, and we may delete or disable access to Customer Content in accordance with our retention practices and applicable law.
Governing Law; Venue
These Terms are governed by the laws of India, without regard to conflict of laws principles. Hikmotic Sol Pvt Ltd is incorporated in India, and the courts located in India shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service, except where prohibited by applicable law.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice.
